Drivers smoking

Had a customer complaint about a driver smelling of smoke really bad and said that the food also smelled of smoke. IMO the driver should not be smoking while on deliveries and it would seem to me since they are handeling food it would be a health violation. I found this information online http://www.health.ny.gov/publications/3402/ however this does not show the employee that it is illegal. Does anyone know of anywhere i can find more on this?

My smoking policy strictly states that they are not to smoke in their vehicle if they have any food with them. This seems to have fixed the issue. Not sure on ALL the legal behind it but everyone seems to comply…not that I am BIG BROTHER and watching them all the time.

As far as I am aware, although it may only be here in Florida, you can require a tobacco free work environment.

They drive my cars. If they smoke in them they are fired. Easy to spot check. Only had to do it once.
